The KL STARTUP SUMMIT website available through the domain “www.klstartupsummit.com” including its associated social media channels, mailing list, newsletters, and all information, data, images, and other content (“Website”) are properties of Pixaworks Creative Sdn Bhd (“Pixaworks” or “our” or “us”), a company registered under the laws of Malaysia, with office at No. 7-2-10, Danau Business Centre, Jalan 3/109F, Taman Danau Desa, 58100 Kuala Lumpur. Additional information about Pixaworks, such as contact details, can be found at www.pixaworks.com.my.
By using this Website or participating in any events organised by KL STARTUP SUMMIT, you agree to be bound by all the terms in this Terms & Conditions. Please note that we reserve the right to amend this Terms & Conditions at our sole discretion, at any time in order to adapt to technical or legal developments or in order to offer new services or goods. The current version of our Terms & Conditions will be available for viewing on our website via the link “Terms & Conditions” at the bottom of the page. Do not use this Website if you do not accept these Terms & Conditions. Your continued use of this Website and/or purchase of ticket(s) is deemed as your acceptance of these terms and conditions.
All references to “you” or “your” or “user” or “buyer” as applicable, means the person that accesses, uses the Website, and purchases ticket(s) via the Website or through our ticketing patners. If you participate on behalf of a business or a company or partnership or limited lability partnership or organization or association (“Legal Entity”), you represent and warrant that you have the authority to bind the Legal Entity and your acceptance of the Terms & Conditions will be deemed an acceptance by the Legal Entity and “you” or “your” or “user” or “buyer” herein shall refer to that Legal Entity.
Registration of Account
To use the services and access any “Restricted Content” available or through the Website, you must register for an account (“Account”) and purchase a ticket via our ticketing partner, Peatix.com. You warrant that you are at least eighteen (18) years of age when you use the Website, register an Account and use the Website to purchase any ticket(s). We are committed to ensuring that your privacy is protected when you make available to us your personal data at the time of registration of your Account. Please refer to our privacy policy which explains how Pixaworks treats and use your information.
When you login to access “Restricted Content”, you warrant that you are the authorised user and that you have provided accurate information about yourself, your company and other relevant information.
Login Details
If you have been issued a login ID in order to access our “Restricted Content”, you may not share your log in ID and password with others. You are responsible for keeping your ID and password secure. You shall be solely responsible for the activities of any persons (whether authorised or unauthorised) using your Account, including all transactions incurred through the use of the Website. Should there be any unauthorised use of your Account (whether within your knowledge or reasonably expected to be within your knowledge), you must immediately notify Pixaworks in writing. All liability, loss, damage and expense howsoever arising from any unauthorised use of your Account by any third parties and/or your failure to secure your username and password are expressly excluded by Pixaworks.
Ticket(s)
All tickets are sold subject to these Terms & Conditions, and should be read carefully prior to purchase and any queries relating to them should be raised with Pixaworks prior to purchase, as purchase of ticket(s) constitutes your agreement of these Terms & Conditions. A valid Ticket must be produced to get into an Event. It is your responsibility to check your ticket(s) on receipt and contact Pixaworks at hello@klstartupsummit.com immediately if there is a mistake.
Price & Payment
The price of the ticket shall be the price set at the time Pixaworks accepts your order. All advertised prices are exclusive of any applicable taxes and transaction fees if any. In the course of registration and purchasing a ticket for the event, the buyer will be able to choose the preferred method of payment. For credit card purchases, the full ticket price is immediately charged to the provided card following successful purchase transactions.
Delivery Policy
Once a successful purchase transaction has been completed, the ticket is delivered in electronic soft-copy via email to the email address provided by the buyer. The ticket additionally serves as a receipt for the transaction and must be used to redeem entry at the event listed on the ticket.
Refund & Cancellation PolicyAll purchases of tickets for conferences and events are non-refundable. If you are unable to attend the Event through no fault of Pixaworks, we can offer a ticket transfer facility in our discretion. In order to obtain a ticket transfer you must contact us 48 hours before the Event via a written request to hello@klstartupsummit.com, including the name of replacement attendee, along with company name and contact details.
Ticket exchange facility will not be available for registrants who choose not to attend the event without prior notice.
Third Party Services
In the “KL STARTUP SUMMIT” website, you may be provided with hyperlinks to other Internet sites or resources, including hyperlinks provided by third party advertisers and sponsors to their products and services.
Pixaworks has no control over those sites and resources, or over the advertising material presented by third party advertisers and sponsors. Pixaworks will not be liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such information, goods or services available on or through any such site or resource. Use of the hyperlinks and access to such third party websites are entirely at your own risk.
Intellectual Property Rights
Pixaworks is the proprietor of the “KL STARTUP SUMMIT” trade name and associated marks. All other trademarks, brand names, copyrights and other intellectual property rights of third parties that are published and depicted on this Website are the trademarks, brand names, copyrights and other intellectual property rights of the respective holders. No permission is given by Pixaworks in respect of the use of any of them and such use may constitute an infringement of the holder’s rights.
All elements of graphics, content, logos, designs, page headers, scripts, branding, and concept on the Website and/or bearing the “KL STARTUP SUMMIT” mark, logo or trade name are the property of Pixaworks at all material times. Users may only reproduce or use these content with Pixaworks’ express written permission.
Viruses, Malware and Errors
Whilst Pixaworks makes every endeavour to keep the Website free from viruses, Pixaworks does not make any guarantee or representations that the Website is secure or free from viruses. You shall take the necessary steps to ensure appropriate security measures are installed on your device or computer and utilize a virus scanner before downloading any information, software or documentation form the Website.
You must not misuse our Website by knowingly introducing viruses, trojans, worms, malware or other material which is malicious or technologically harmful.
Limitation of Liability
Without prejudice to the foregoing, in the event of a court or tribunal holds or finds Pixaworks liable to you for any breach or default of the Terms & Conditions, you agree that the amount of costs, expenses and damages payable by Pixaworks to you or such third parties shall not at any time exceed the sum of your payment amount to Pixaworks for the ticket(s) at such time of that order, notwithstanding any order, decree or judgment to the contrary.
Jurisdiction Policy
The courts of the Malaysia will have exclusive jurisdiction to adjudicate any dispute arising under or in connection with these Terms & Conditions.
